Barry Mukamal Helps Defeat $10 Million Class Action Lawsuit

 

As reported in the Daily Business Review on June 19, 2017, “Putting on ‘a numbers case’ helped the owners of the Hilton Ft Lauderdale Beach condo hotel defeat a $10 million class action lawsuit. ”

 

Providing expert testimony in hotel accounting, Barry Mukamal, along with a team of commercial lawyers from Burr & Forman in Fort Lauderdale succeeded in demonstrating what constituted costs. Proving that the hotel had incurred the charges claimed for shared services exposed a significant accounting error, resulting in the hotel having paid millions over the years that should have been borne by the mixed use hotel condo owners.  Over the years, residents paid a disproportionate amount of costs such as parking, property management, maintenance, real estate taxes, etc.

 

What we did was “debunk the plaintiffs’ argument that there was a lack of transparency and highlighted the plaintiffs’ failure to look at the evidence which supported the facts.”  The jury was persuaded by Mukamal’s testimony over two days that walked them through the process and facts and explained the proper functioning of a condo hotel structure.
